How to Enter:

Follow @quayaustralia + @saweetie, Like and Comment with the @name of a friend on @quayaustralia post regarding of the Giveaway between June 1 5:00am PT- and June 8th 11:59pm PT (“Entry Period”). In the event of a dispute as to the identity of a winner, the winner will be deemed to be the person in whose name the e-mail account governing the e-mail address was opened to create the associated winning Instagram account. Any effort by an entrant to misrepresent themselves through the use of aliases or multiple e-mail addresses will disqualify all entries of such individual. Sponsor and its agents reserve the right to verify eligibility qualifications of any winner. Failure to comply with these Official Rules as determined in the sole discretion of Sponsor may result in disqualification from the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. Entrants must provide all information requested to be eligible to win. Incomplete, unreadable, or unintelligible entries will be disqualified. All entries must be received by June 8th 11:59pm PT. All information provided by entrants becomes the property of Sponsor. Winners will be notified by Instagram Direct Message. Entries must be public and comply with the Instagram Terms of Use available at https://instagram.com. Instagram privacy settings may be adjusted by changing the security and privacy settings in your Instagram account. If you choose to participate using your mobile phone, standard data fees may apply. See your wireless provider for pricing plan details. There is no limit on the number of online entries per entrant during the entry period. You will receive one entry per comment and may submit as many email entries as you wish. Giveaway is not sponsored or endorsed by Instagram.

Prizes and Odds:  The odds of winning a prize depend on the total number of eligible entries received. One (1) grand prize to be awarded from the promotion are as follows:

• The winner will receive two (2) American Express® Gift Cards (“Gift Cards”) worth Two Thousand Dollars ($2000.00) USD. Use of Gift Cards is limited only at U.S. merchants that accept American Express® Cards, except for recurring payment. No ATM use. Funds do not expire. ARV is as of date of printing of these Official Rules. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded.  Limit: one (1) prize per person.  Prizes are non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value.  Prize winners will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used. Prizes must be accepted as awarded. No prize substitutions, cash equivalent, or transfer of prizes permitted except as required by law or at the sole discretion of Sponsor. All taxes for the prize are the sole responsibility of the individual winner. Any prize is provided "as is'' and without any warranty of any kind. Each winner hereby acknowledges that Sponsor and its affiliates have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize or component thereof, including any express or implied warranties provided by any of the prize providers associated with this Giveaway. By accepting the prize, each winner acknowledges the sufficiency of the prize is awarded.

1. Eligibility: The Giveaway is open to legal residents of the U.S. age 18 or older, who have an active e-mail account and Internet access as of the beginning of the promotion period. Employees of Sponsors and their respective parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to participate in the promotion. Participation in the promotion constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules & Regulations ("Official Rules"). VOID WHERE PROHIBITED.

No mechanically reproduced email-in entries are allowed and any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods.

2. Prize Drawing: All promotion/contest name entries meeting the requirements of these Official Rules will be entered into the prize drawing, to be held on or around 10 days after online deadline at the Quay Australia offices 821 Howard St San Francisco, CA 94103 The winners will be selected at random from among all eligible entries received. The odds of winning a prize depend on the total number of eligible entries received. Winners are solely responsible for any and all federal, state, provincial and local taxes that apply to prizes. No cash or other substitution of prizes is permitted, except at the sole option of Sponsor for a prize of equal or greater value. Prizes won by minors will be awarded to the parents or legal guardians, who must sign all required affidavits and releases. Sponsor will not replace any lost or stolen prizes.
3. Notification of Winners: Winners will be notified by e-mail within five (5) business days of the prize drawing and may be required to sign and return an affidavit of eligibility and publicity /liability release to be signed within seven (7) days of notification. If a selected Winner cannot be contacted, is ineligible, fails to claim a prize and/or where applicable an affidavit of eligibility and publicity /liability release is not timely received, is incomplete or modified, prize may be forfeited and an alternate Winner will be selected from remaining valid, eligible entries timely submitted. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the e-mail account specified in the entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No automatically generated entries will be accepted.
4. Privacy Policy: Any personal information supplied by you to Quay will be subject to Quay Australia s privacy policy posted at https://www.quayaustralia.com/pages/privacy-policy Quay Australia will not sell, rent, transfer or otherwise disclose your personal data to any third party other than the corresponding Sponsor whose offers you failed to opt-out. Additionally, by entering the promotion/contest you understand that Quay Australia may send you additional commercial marketing email regarding Quay Australia and its partners.
5. General Rules: By entering, you agree to be bound by these Official Rules, including the eligibility requirements set forth herein and to accept the decisions of Sponsor, as final and binding as it relates to the Giveaway. The promotion is offered by Sponsor, Quay Australia 821 Howard St San Francisco, CA 94103 which is not responsible for late, lost, delayed, damaged, incomplete, illegible, or misdirected entries, responses, or other correspondence, whether by e-mail or postal mail or otherwise, or for theft or destruction or unauthorized access or alterations of entry materials, phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties. By participating and winning a prize, Winner releases Sponsor, its parent, affiliates, subsidiaries, directors, officers, employees, sponsors, and agents, including advertising and promotion agencies, from any and all liability with respect to the promotion/contest or the acceptance, possession or use of any prize, including without limitation (i) any condition caused by events beyond Sponsor’s control that may cause the promotion/contest to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the QUAY X SAWEETIE SUMMER GIVEAWAY and (iii) any printing or typographical errors in any materials associated with the promotion/contest. Sponsor’s decisions in all respects relative to the promotion are final. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the promotion in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the promotion is compromised, without liability to the entrant. Sponsor reserves the right to disqualify any winner, as determined by Sponsor in its sole discretion. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The winner is responsible for paying any income taxes on the value of the prize received. Void where prohibited or restricted by law. All federal, state, provincial and local regulations apply.
6. Additional Conditions: Except where prohibited by law, by accepting any prize, Winner consents to the use of his/her name, photo and/or likeness, biographical information, winning entry and statements attributed to winner (if true) for advertising and promotional purposes without additional compensation. All entries become property of Sponsor and none will be acknowledged or returned. Allow 6-8 weeks for delivery of prizes.

9. Governing Law: This Giveaway and its Official Rules are governed by US law and are subject to all applicable federal, state and local laws and regulations. All issues and questions concerning the construction, validity, interpretation and enforceability of the Giveaway Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Giveaway , shall be governed by, and construed in accordance with, the laws of the State of California U.S.A. ANY CLAIMS, JUDGMENTS, AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS GIVEAWAY. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
